The FAQ now answers what happens to your files if NMTS goes down — measured, not guessed.

Our own backlog carried a guess since July: that downloads would survive an outage and only uploads would stop. We measured it, and it is close to the opposite — if our server cannot be reached, your drive still opens from the list on your device and any unsaved change says so on screen, but downloads cannot start at all, because only our server knows which piece of your file sits where on the storage network. The encrypted file list on your device carries your keys and your file names; it does not carry those locations. The route that does work is your recovery list, which carries them, so while we are the thing that is down the recovery tool reaches your files and our own drive does not — while the storage network itself is down, neither does.
